CHAPTER 327 - ODOMETERS

Sec. 32703. Preventing tampering
-STATUTE-
A person may not -
(1) advertise for sale, sell, use, install, or have installed,
a device that makes an odometer of a motor vehicle register a
mileage different from the mileage the vehicle was driven, as
registered by the odometer within the designed tolerance of the
manufacturer of the odometer;
(2) disconnect, reset, alter, or have disconnected, reset, or
altered, an odometer of a motor vehicle intending to change the
mileage registered by the odometer;
(3) with intent to defraud, operate a motor vehicle on a
street, road, or highway if the person knows that the odometer of
the vehicle is disconnected or not operating; or
(4) conspire to violate this section or section 32704 or 32705
of this title.

I have a friend who's an FBI agent in Indy. Maybe I'll send him an email about Bob. :-)
Since the PROOF of Bob advertising such a mechanism for sale has been shown, not only by screenshot, but by BOB'S OWN ADMISSION on Columbuzz (he'll delete that comment as well...hide and watch), then BOB FREEMAN HAS COMMITTED A CRIME.
I'm guessing this precludes Bob from EVER running for public office EVER AGAIN.

Of course Fred Barkes is not a criminal. He is an honorable man who is the latest focus of the insanity rants of Bob Freeman. Fred Barkes is just the latest victim of threats and God knows what else from the "Idiot on Lilac."
Since it is a federal crime, they now have probable cause to secure IP info from the garage sale website and obtain a warrant to seize Bob's hard drive.

This is akin to a car ring in that it is in essence rolling back odometers (though not all the way) to make a car appear to have more life and less wear and tear than it really does. Have at it.

Now this is indeed an important point, but the liability protection vanishes as soon as the moderator (Bob) modifies a user's comments - they effectively become his own.
So to follow Bob's lame example, if John Q. User posts a comment and Jeremy modifies it before it is posted, then that comment is actually Jeremy's and he therefore accepts liability.
These, of course, are criminal law's being discussed. It would be up to a Bartholomew County Jury to determine malice, slander and so on and that is after Bob's hard drive has been searched and all of his commentary nailed down.
Columbuzzz can still be served civil process to search the materials to determine where they came from. Bob and Columbuzzz can be subject to civil litigation just not prosecuted criminally for the comments posted.
He is NOT absolved of responsibility. Sorry, Bob.
There is a difference between the Federal Criminal Code and the Indiana Revised Statutes regarding malice, slander and so on. There is a huge difference. The burden of proof in civil court is many times much easier than proving a Federal Criminal case.

What exactly is an F&Q?!? I think they mean FAQ or Q&As. Amateurs.
It depends on whether a comment can be posted directly or whether it is screened or goes through a registration process. I would have to look into this but I am pretty sure Columbuzz does not operate as a blog. Laws concerning blog posts are different that "news and information sites" and logging and and registration are points of law.

I would love to see a civil case against columbuzz. Bob is such an egomaniac, he would probably act as his own lawyer in court. I would pay money to watch that. He would be constantly cited for contempt.
Just an overview but it seems like Fred Barkes and his family would have a case. Most of what Bob Freeman says just does not rise to the level of serious litigation, however, deriding a public official may seem noble but there comes a point in time when the line is crossed. In my opinion, Bob has clearly crossed that line more than once.
As a matter for law enforcement, the issues involving the odometer device are serious and worthy of being reported to the appropriate law enforcement agencies. I will guess that any investigation of Bob Freeman would likely turn up more violations of state and federal law.
For those who want to consider a lawsuit against Freeman, you can always take him to small claims court. That would be a sight to see!
